Hawaii Car Crashes

Car crashes that cause injuries and fatalities happen in the state of Hawaii for a long list of reasons. Regrettably, most of them are caused by the actions of negligent drivers. Speeding and driver intoxication are two widespread forms of driver negligence seen in the Aloha State. Crashes that happen when people are traveling at unsafe speeds usually result in more severe injuries and a higher number of fatalities than other types of collisions. Driver negligence is the main contributing factor in car crashes in Hawaii and throughout the United States.

Approximately ¼ of fatalities related to American traffic accidents were caused by driver intoxication in 2020. About 75% of the deceased victims were drinking and driving when they lost their lives. When people choose to drink/do drugs and drive, their ability to correctly navigate the road can be obliterated, causing severely dangerous situations to arise. Accidents caused by drivers who are intoxicated are usually more devastating than any other type of crash.

If you or someone you love has been injured in an accident caused by speeding, intoxication, or another form of driver negligence, you may be eligible to collect financial compensation. Losses and damages caused by your crash, including the costs related to medical bills, lost earnings, medical care costs, and more may be able to be covered by financial compensation when you file a personal injury claim with a lawyer. A car crash attorney in Hawaii can help you do this.

The personal injury attorneys at Leavitt, Yamane, & Soldner have over 20 years of experience helping injured accident victims get the justice and compensation they are entitled to after being hurt by the negligent actions of irresponsible and inexperienced drivers. A personal injury attorney should be the only individual you discuss your accident with, and it is especially important to remember never to discuss the details of your crash with the insurance company.

Our lawyers are acutely aware of the stressful nature of situations like these, which is why we are here to help you recover. Call our firm as soon as you can at (808) 537-2525 to speak with an attorney regarding your case.

Especially in the past decade, driver negligence has become a serious and dangerous issue throughout the country. This is most likely because the majority of people cannot go even 10 minutes without looking at their cell phones. Even if they are behind the wheel of a moving vehicle on a busy road, some drivers still feel the need to pull out their phones and stare at the screen. Distracted driving remains a leading cause of accidents in Hawaii, as it increases the likelihood of motorists making mistakes while driving. Hawaii Car Crashes

Motor vehicle accidents across the island of Hawaii repeatedly result in catastrophic injuries and severe property damage. The vehicles involved are often rendered undrivable, and occupants lose their lives in the most severe instances. Regardless of the seriousness of an automobile collision, however, there are a few things that always ring true. Without a doubt, insurance companies will be involved.

As with the insurance requirements in most states, the required minimum coverage in Hawaii is fairly low, especially when a serious injury that costs an average of $20,000 in medical bills and an emergency room visit is involved.

Hawaii requires all drivers to purchase and maintain the following:

  • $10,000 in Personal Injury Protection per person
  • $10,000 in property damage liability per accident
  • $40,000 per accident/$20,000 per person bodily injury liability

All other forms of insurance coverage are optional, including uninsured and underinsured coverage, collision and comprehensive, funeral benefits, death benefits, and alternative care such as naturopathy or acupuncture, just to name a few.

Hawaii follows a modified comparative negligence rule, which means, for example, in a two-vehicle crash, it might be determined that both drivers have contributed to some percentage of the negligence.

The modified comparative negligence rule, also called the 51% rule, states that if your percentage of fault is greater than 50%, you are barred from obtaining any financial compensation from the other driver.

Hawaii also adheres to a no-fault auto insurance policy, meaning that, barring severe injuries, you will have to pursue compensation from your own insurance policy and its personal injury protection. No-fault policies only apply to injuries, not to any form of property damage. The at-fault party is liable for those.

At the law offices of Leavitt, Yamane & Soldner, we provide our clients with peace of mind. While you are healing from your injuries, we are working to get you the compensation you are entitled to for your damages.

Hawaii Motorcycle Collisions

All different types of auto accidents happen throughout the state of Hawaii and across the United States each year. Motorcycle crashes are some of the most catastrophic types of auto accidents that occur on roadways throughout the United States. Every year, thousands of people sustain severe injuries and lose their lives in motorcycle collisions in the United States.

Each year, the US sees about 90,000 injuries that result from motorcycle accidents and nearly 5,000 fatalities. Obviously, motorcyclists are more prone to becoming seriously injured due to traveling with little to no protection against the force of faster, larger vehicles. If a motorcyclist becomes involved in a collision with a passenger car, they are more likely to suffer severe or even fatal injuries than those who are riding in the vehicle.

In Hawaii, there are a large number of motorcyclists. Due to the beautiful scenery and nice weather, it is a popular place to ride mopeds and motorcycles year-round. This is a fact that should be considered by all motorists in Hawaii. Drivers in Hawaii should keep an eye out for motorcyclists at all times, as they are more common there than in other states. When you’re injured as a motorcyclist in a car wreck, it is likely that your crash was caused by driver negligence.

Statistics concerning motorcycle accidents in the United States show that about 50% of reported motorcycle crashes happen due to the actions of negligent drivers– not the motorcyclists themselves. The most common reason motorcycle crashes happen in the US is drivers failing to yield the right of way. When you or a loved one sustains severe injuries in a motorcycle crash, you should contact a motorcycle accident lawyer in Maui as soon as you can.

You may be eligible for financial compensation for damages like pain, suffering, loss of enjoyment of life, medical bills, vehicle repair costs, wage loss, and more. Call the law office of Leavitt, Yamane, & Soldner as soon as you can at (808) 537-2525 to learn more about your legal right toward financial compensation if you were hurt as a motorcyclist in an accident.
